Terms and Conditions

General Terms

All participants must be at least 6 years of age or able to competently paddle without assistance in order to paddle their own vessel. Children under 6 years of age will be permitted to ride with an accompanying adult provided the life vest provided fits correctly (Min body weight 12kg).

All children MUST be supervised by a guardian 18 years of age or older whilst on the water

All participants hire equipment at their own risk and are required to sign a ‘Hire Agreement’ prior to departure.

Participants must not to carry more than the maximum limit of people authorized by Port Stephens Paddlesports and the Australian Marine Safety Authority (AMSA) as listed: Single Kayak = 1 ad + 1 ch under 4 yrs; Double Kayak = 2 ad + 1 ch under 4 yrs; Stand Up Paddle Board = 2 ad not exceeding a 120kg capacity; Catamaran Paddle Board = 3 to 4 ad not exceeding a 220kg capacity.

Participants must wear appropriate clothing for paddle/water sport activity. JEANS ARE NOT ALLOWED.

Use of equipment is not permitted between the hours of sunset and sunrise.

Participants are wholly responsible for the hire equipment, its passengers and appliances and third parties whilst the Kayaks/SUP(s) or equipment are in their control for the period of hire. Participants agree to exercise due care and accept responsibility, during the same period, toward any incident that may occur, and will promptly reimburse Port Stephens Paddlesports in the event of any loss or damage to the equipment and/or to any other person or property.

Participants agree to return the hire equipment to Port Stephens Paddlesports at the POINT OF HIRE on completion of the agreed hire period.

Participants acknowledge the inherit dangers and risks and agree that the hiring of the equipment is entirely at their own risk.

Participants shall indemnify Port Stephens Paddlesports of any incident, loss or damage to the equipment, any third party person or property during the period of the hiring and acknowledge that they will not be covered by any of Port Stephens Paddlesports insurance if found negligent or irresponsible whilst the kayak, SUP or any equipment is under their control.

Port Stephens Paddlesports will not be held responsible for any personal injuries, equipment loss or damage sustained whilst embarking or disembarking Port Stephens Paddlesports equipment

Passengers with back, neck, shoulder or heart conditions, or those who are pregnant or who have injuries/conditions that may cause a risk to their health participate at their own risk

Port Stephens Paddlesports operates in an outdoor marine environment.

Conditions vary and passengers will get wet.

No smoking or alcohol is permitted on the equipment at any time.

Port Stephens Paddlesports reserves the right to refuse service to those who are believed to be affected by alcohol or drugs and no refund will be provided.

Port Stephens Paddlesports reserves the right to refuse passengers for any reason.

Participants may be filmed/photographed during the hire period. Port Stephens Paddlesports reserves the right to reproduce such film/photos for any purpose whatsoever without notification, compensation or payment.

 

Booking Conditions

All bookings (including gift voucher/certificate bookings) are non-refundable within 24 hours of departure.

Cancellations must be received at least 24 hours prior to departure or full payment will be due and no refund will be given

Full refund is permitted on booking cancellations made outside of 24 hours from departure time.

Rescheduling of a booking is permitted outside of 24 hours from departure time

Any cancellations or non arrivals within 24 hours will incur a 100% cancellation fee.

Bookings made within 24 hours of departure are non-refundable.

Port Stephens Paddlesports reserves all rights to cancel or reschedule the activity in the event of adverse weather conditions or other unforeseen circumstances.

It is up to Port Stephens Paddlesports discretion as to whether it is safe for bookings to go ahead.

Port Stephens Paddlesports reserves all rights to cancel or reschedule an activity if numbers do not meet the minimum requirements.

If Port Stephens Paddlesports must cancel an activity due to inclement weather, or for any other reason, the activity will be rescheduled. If the activity cannot be rescheduled full refund will be processed.

Kayak Tour Conditions:

All prices included are inclusive of GST.

No refund will be given for bookings cancelled within 24 hours of scheduled tour departure.

Port Stephens Paddlesports reserves the right to cancel tours at short notice due to unsuitable weather/sea condition or any other reason. If a cancellation occurs, Port Stephens Paddlesports will attempt to re-schedule. If the tour cannot be rescheduled a full refund will be provided.

Our tours are of moderate to long distance, and involve paddling away from the shore line within exposed marine surroundings ie: possible wind, tidal current and rip tides. Port Stephens Paddlesports endeavors to provide a safe experience, as easygoing as possible however, all participants must acknowledge this BEFORE PROCEEDING and be confident of their fitness levels and adventurous nature before deciding to participate.

All Adults MUST have swimming ability despite being provided with a PFD. It is preferred that children have swimming ability and/or are confident within a marine environment.
